Send a message to protect Wind Power!
SB1793/HB1731, as amended, is scarily close to becoming law. It is in the Senate Calendar Committee and could be voted on in the full Senate with little warning. On the House side, it is in the full Agriculture Committee, with only a couple steps before it comes to a vote. It is clumsy attempt to regulate wind-power out of existence in the state.
Our message to legislators is below:
This bill forbids potential wind power operators from doing any construction until after they have received a Certificate of Public Convenience and Necessity. The amendment goes on to define the term 'construction' in a way that includes basic things like planning, research and feasibility analysis. However, that certificate requires applicants to provide information to the state that the bill forbids them from figuring out before they have the certificate!
What's more, each county in Tennessee is different and this bill doesn't give local governments sufficient ability to tailor their regulations to their own needs. Instead of empowering local governments to make smart decisions on wind, this bill saddles local governments with an oppressive regulatory regime. The requirements of this bill might make sense in some locales, but trample on common sense and property rights in other parts of the state.
